TERMS & CONDITIONS
FIT FEMME BY JESS – TERMS & CONDITIONS AGREEMENT
By participating in any service offered by Fit Femme by Jess, the client acknowledges that they have read, understood, and agree to the following Terms & Conditions:
1. Memberships
- All memberships are non-transferable and valid for individual use only.
- Clients may choose from the following payment options:
- Direct Debit: Weekly payments will be processed via Ezidebit. A setup form will be provided upon selection. Please review Ezidebit’s terms and conditions carefully, as all associated fees are governed by their policies.
- Cash: One-month prepaid option available.
2. Personal Training Sessions
- Appointment confirmation will be sent via SMS the day before your scheduled session. It is essential to respond to confirm, reschedule, or cancel.
- Cancellations: Cancellations made at the time of SMS confirmation will not incur a fee.
- Late cancellations (the evening prior or day of the session) and no-shows will be charged in full, except in cases of emergency (e.g., illness, accidents, personal tragedy). No refunds will be provided.
- Sessions are 30 or 45 minutes in length. Please arrive on time, as lateness will reduce your session duration.
- Memberships may be paused for holidays (up to four weeks per year). Note: your regular time slot may be reassigned during this period.
3. Group Classes
- A minimum of three participants is required for a class to proceed.
- Clients must pre-book online/notify Jess at least 24 hours before class.
- Classes may be cancelled due to low attendance, coach illness, or holiday closures.
- Cancellations within 24 hours or no-shows will result in forfeiture of the class fee, unless under emergency circumstances. No refunds.
4. Membership Cancellation
- Memberships may be cancelled at any time, subject to a cancellation fee equivalent to one week's membership.
- Clients may continue to train during the final paid week or forfeit the remaining sessions.
- No refunds will be issued.
5. Personal Training Liability & Medical Clearance
- Personal Training is conducted by certified coach Jessica Bongiorno. Emphasis is placed on proper form and technique to ensure safety and effectiveness. However, participation is at the client’s own risk, and Jessica Bongiorno assumes no liability for personal injury.
- Clients with pre-existing medical conditions or injuries must obtain clearance from a medical professional prior to participating.
- Clients choosing to participate without medical clearance do so at their own risk. Responsibility will not be accepted under any circumstances.
6. Nutrition Programs
- All Nutrition Programs are self-directed. Jessica Bongiorno is not liable for any injury, allergic reaction, or illness resulting from participation.
- Clients must disclose any food allergies or intolerances and seek clearance from a General Practitioner prior to commencement.
- Participation without medical clearance is at the client’s own risk.
- No refunds will be provided.
7. Intellectual Property
All Coaching Materials and Nutrition Plans are the intellectual property of Jessica Bongiorno. No persons are permitted to:
- Reproduce
- Distribute or redistribute
- Create derivative works from
- Publicly display any content without explicit written consent.
Legal action will be taken for any unauthorised use.
8. PTP Products
By purchasing PTP fitness products, the client agrees to the following:
1. No refunds or exchanges will be offered for change of mind. Please choose carefully.
2. Defective or faulty items may be eligible for exchange, pending assessment. This does not apply to damage caused by misuse, improper handling, or normal wear and tear.
3. Items purchased via Instagram (@fitfemmeofficial) must be paid in full prior to dispatch. No holds or reservations.
4. Orders placed before 2:00 PM will be shipped the same day.
5. Postage fees apply based on quantity, size, and weight via Australia Post.
6. Unauthorised resale or redistribution of PTP products is strictly prohibited and may result in legal proceedings.
